1. About these terms

These terms govern your use of the Badminwear watch app, account website, recording service, and live-score viewer. By using Badminwear, you agree to these terms. If you do not agree, do not use the service. You must be 18 or older to create an account or use the watch app. Badminwear is not for children.

Our privacy policy explains how personal information is handled. Accepting these terms does not replace consent required for health data, microphone recording, or a separate use of recordings for model development.

3. Your account

Provide accurate account information and keep your password, watch, and session credentials secure. Pair only watches you are authorized to use. A pairing code links a watch to the account that claims it, so share it only with the intended account holder.

You are responsible for use you authorize through your account. Tell us if you suspect unauthorized access. Signing out of one browser does not necessarily sign out your paired watch or other sessions. You are responsible for any device, connectivity, or mobile data charges from your providers.

4. Recording and sharing responsibly

Outside Lite mode, connected match recording captures heart rate, wrist motion, and microphone audio. The watch turns that audio into volume bands on the device, and only those bands are uploaded — the audio itself is never transmitted, stored, or shared. The microphone can still hear nearby speech throughout the session, including people who do not use Badminwear. Before recording, inform participants and obtain any consent or permission required by local law and your venue. Do not record where recording is prohibited. Enable Lite mode when you do not want microphone recording or live scores.

Anyone who has your live-score link, QR code, or match identifier can view the scoring feed without an account and can pass it on. Share links only when you are comfortable with others seeing that match’s score and scoring times. We cannot retrieve screenshots or copies saved by viewers. Live scores do not include your audio, its volume bands, or your health readings.

5. Acceptable use

Use Badminwear lawfully and respect other people’s privacy and rights. Do not:

• Access another person’s account or private recordings without authorization.
• Upload recordings you have no right to collect or share, or use the service for covert surveillance or harassment.
• Interfere with scores you are not authorized to manage, bypass access controls, or disrupt the service.
• Upload malicious content, abuse the APIs, or place unreasonable load on the infrastructure.
• Misrepresent Badminwear’s outputs as certified medical advice or guaranteed sporting results.

6. Your data and our software

You retain any rights you have in the information and recordings you provide. You give us permission to store, process, and display that content as needed to provide the features you request, including transmitting scores to live-score viewers. This permission is limited by the privacy policy and your applicable data protection rights; it is not a transfer of ownership or blanket permission to use recordings for unrelated purposes.

Badminwear’s software, branding, and site content belong to their respective rights holders. You may use the app and website for their intended purposes. Components distributed under an open-source or other separate license remain governed by that license. These terms do not restrict rights that applicable law or those licenses give you.

7. Accuracy, exercise, and availability

Scores depend on your input. Sensor readings, timing, statistics, and any automated analysis can be incomplete or inaccurate. Treat analysis and coaching as general sporting information, not medical advice, diagnosis, or a guarantee of improvement. Use your own judgment when exercising and do not let the watch distract you from safe play.

We aim to keep the service working, but cannot guarantee uninterrupted access, live-score delivery, successful recording, or recovery of lost data. Battery limits, missing permissions, device failures, and network outages can interrupt a match. Uploads may be queued and retried after the app closes. Keep a separate record of any score or information you cannot afford to lose.

We may maintain, update, or discontinue features, subject to applicable law. If paid features are introduced, their price and any additional purchase terms will be shown before purchase; these terms alone do not authorize a charge.

8. Ending your use

You can stop using Badminwear at any time or enable Lite mode for use without a login, microphone recording, or live scores. You can delete your account in the dashboard, or contact us to request deletion of your account, server data, or separate analysis exports. Signing out or uninstalling the app does not itself delete previously uploaded information. Retention and deletion are explained in the privacy policy .

We may restrict or suspend access where reasonably necessary to address a serious breach of these terms, protect people or the service, or comply with law. Where practical and lawful, we will explain the reason and give you an opportunity to resolve the issue. Suspension does not remove your applicable rights to request access to or deletion of your personal data.

9. Responsibility and disputes

To the extent permitted by law, the service is provided as available, without a promise that it will meet every purpose or be free from errors. We are not responsible for losses caused by circumstances outside our reasonable control, or losses that were not reasonably foreseeable.

Nothing in these terms excludes responsibility for fraud, deliberate misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be excluded. Your mandatory consumer rights and statutory remedies remain unaffected.

Contact us first so we can try to resolve a concern. These terms do not require arbitration or prevent you from bringing a claim before a court available to you under applicable law. Any mandatory protections and jurisdiction rights in your country of residence continue to apply.

10. Changes and contact

We may revise these terms as Badminwear evolves. We will update the date and give appropriate notice of material changes before they take effect, unless an urgent legal or security change requires otherwise. Where the law requires your agreement to a change, we will obtain it. If you do not accept revised terms, you may stop using the service and request deletion of your account.
